Terms and Conditions of Enrollment and Use

Welcome to Kainos American University (“Kainos,” “we,” “our,” or “us”).
These Terms and Conditions (“Terms”) govern your access to and use of Kainos American University services, programs, website, and educational offerings.
By registering, enrolling, or accessing any course or service, you (“Student,” “User,” or “you”) agree to be legally bound by these Terms.
1. Nature of Services
Kainos American University provides access to online certificate and continuing education programs, educational resources, and academic support services.
Kainos American University primarily operates as an educational facilitator and program intermediary, connecting students with online learning opportunities offered either:
- Directly by Kainos University; or
- Through independent third-party educational providers.
2. Third-Party Course Providers
Many courses available through Kainos American University are delivered through independent educational providers, including but not limited to MindEdge Learning (“Third-Party Provider”).
By enrolling, you acknowledge and agree that:
- Course instruction, delivery, grading, and academic evaluation for third-party courses are conducted solely by the Third-Party Provider.
- Kainos American University does not control course content, instructional methods, grading standards, or academic decisions made by Third-Party Providers.
Students may be required to accept additional terms and policies established by the Third-Party Provider.
3. Educational Intermediary Role
Kainos American University acts as a facilitator of educational access and is not the primary instructional provider for courses delivered by third parties.
Accordingly:
- Kainos does not guarantee academic outcomes.
- Kainos does not supervise instructors employed by third-party providers.
- Academic disputes must be addressed according to the policies of the course provider.
4. Payments and Financial Responsibility
Payment arrangements may vary depending on the program.
Students acknowledge that:
- Tuition or course fees may be paid directly to a Third-Party Provider.
- Refunds, billing disputes, and financial policies for third-party courses are governed by that provider’s policies.
- Kainos American University is not responsible for refund decisions made by Third-Party Providers.
Kainos reserves the right to modify payment structures or partners at any time.
5. Certificates and Program Completion
Certificates may be issued by:
- Kainos University,
- A Third-Party Provider, or
- Jointly by both organizations.
Completion requirements are determined by the entity delivering the course.
Enrollment or payment does not guarantee certificate issuance.
6. No Guarantee of Educational or Employment Outcomes
Kainos American University does not guarantee:
- Academic success,
- Skill mastery,
- Professional certification,
- Licensure eligibility, or
- Employment opportunities.
Programs are intended for educational and professional development purposes only.
7. Technology and Platform Access
Courses may be accessed through external learning platforms operated by Third-Party Providers.
Kainos American University is not responsible for:
- Platform outages,
- Technical failures,
- Internet connectivity issues,
- Software compatibility problems, or
- Loss of access caused by third-party systems.
8. Student Responsibilities
Students agree to:
- Provide accurate registration information.
- Maintain confidentiality of login credentials.
- Follow academic integrity standards.
- Comply with both Kainos American University policies and Third-Party Provider rules.
- Use platforms respectfully and lawfully.
Kainos reserves the right to suspend or terminate access for misconduct.
9. Language of Instruction
Courses may be offered in English or Spanish.
Students are responsible for ensuring adequate language proficiency for successful participation.
Kainos American University is not responsible for comprehension difficulties resulting from language limitations.
10. Independent Relationship
Third-Party Providers operate independently.
They are not employees, agents, partners, or representatives of Kainos University.
Kainos American University is not liable for actions, omissions, or decisions made by Third-Party Providers.
11. Intellectual Property
All course materials, logos, content, videos, and educational resources remain the intellectual property of their respective owners.
Students may not:
- Copy,
- Record,
- Redistribute,
- Sell, or
- Publicly share course materials without written permission.
12. Limitation of Liability
To the fullest extent permitted by law, Kainos American University shall not be liable for:
- Educational dissatisfaction,
- Academic performance outcomes,
- Platform interruptions,
- Financial losses,
- Indirect or consequential damages arising from course participation.
13. Program Modifications
Kainos American University reserves the right to:
- Modify programs,
- Change course providers,
- Adjust pricing,
- Update schedules, or
- Discontinue offerings at its discretion.
14. Termination of Access
Kainos American University may suspend or terminate access if a student:
- Violates these Terms,
- Engages in misconduct,
- Misuses educational platforms, or
- Fails to comply with policies.
15. Privacy
Student data is handled according to Kainos University’s Privacy Policy.
Students acknowledge that information may be shared with Third-Party Providers solely for educational administration purposes.
16. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Texas, United States, without regard to conflict-of-law principles.
17. Changes to Terms
Kainos American University may update these Terms periodically.
Continued use of services after updates constitutes acceptance of revised Terms.
